Profile

Nicholas read Economics Part I and Law Part II at Cambridge, and then took the top First in the Bar Finals. He joined us on the move to New Square in 1999.

He practises in professional liability, commercial and related civil litigation.

Particular areas of expertise include insurance disputes, substantial professional liability claims particularly involving lawyers, also financial services professionals including insurance brokers and agents.

Nicholas' work as a junior had notable breadth, including working for B&Q throughout the Sunday Trading saga (including its EU aspects), commercial work, computer contract claims and, especially, professional (other than clinical) liability. Although his first trial in Silk was (against Justin Fenwick) in a surveyors' liability case, in the mid to late 90s he was engaged mainly in claims involving solicitors, especially in the heavyweight litigation brought by first the Bristol and West, then the Nationwide, Building Societies. Each Society's claim was against hundreds of firms of solicitors, and tested both common law and equitable remedies and required large numbers of claims to be carefully managed in the Chancery Division. Three cases in the House of Lords in 2001-2 included the major cases on deliberate concealment (Cave) and wasted costs (Medcalf v. Mardell).

Nicholas regularly acts for claimants as well as defendants in heavyweight litigation, including for accountants Kidsons in a major insurance dispute, for Cambridge City Football Club in having a deal in relation to their ground set aside for fraud and bribery, for Newcastle Airport in retrieving from its former Chief Executive and the Estate of its former Finance Director about £4m of contentious bonuses, for an importing company in an 8-figure claim against its insurance brokers, and in investment advice and management disputes involving major investment houses.  He is involved in all aspects of fall-out from mortgage fraud claims, including the main claims, contribution claims and insurance issues.

Nicholas’ practice has often involved valuation problems, including experience of the problem of valuation in a market in which trading has dried up.
