Profile
Paul practises principally in professional liability, construction / IT law and insurance. He is particularly interested in complex technical cases and all aspects of architects’ and engineers’ liability. Paul thrives on cases involving difficult questions of expert evidence, and on all document heavy cases. Paul’s numeracy and background in applied mathematics enables him to deal efficiently and effectively with IT and other computing and technological cases, and with challenging accounting and quantum issues.
As a former lecturer in law at King’s College London, Paul has substantial expertise and experience in pure points of negligence and contract law. Paul acted as junior Counsel for the successful contractor in the leading “No Loss” case in the House of Lords, McAlpine v Panatown [2001] 1 AC 518, and for the successful consultant in another recent No Loss preliminary issue in Rolls Royce Power Engineering Plc v Ricardo Consulting Engineers Ltd [2004] 2 All ER (Comm) 129.
Paul also regularly acts in insurance disputes and has conducted a number of arbitrations on policy issues and fraud allegations. He recently acted in the leading insurance case in the Commercial Court of Bovis v Lumbermens [2005] 1Lloyd’s Rep 494.
Paul has also acted in a number of disputes in Ireland (including the new Dublin Sports Stadium and various insurance disputes), in the Isle of Man (granted rights of audience) and in the Channel Islands.
For much of 2006 Paul acted for Multiplex in a series of successful adjudications against the Football Association in respect of the Wembley Stadium dispute, culminating in proceedings in the Technology and Construction Court.
Paul’s expertise in construction and technical cases, and his background in teaching criminal law and evidence at King’s College London, has led to a further specialisation in defending companies (including the Channel Tunnel Rail Link consortium) in relation to regulatory offences involving noise pollution, water pollution and health and safety relates offences.
Paul is an editor of Jackson & Powell’s Professional Liability (6th ed, January 2007), and is a member of TECBAR, PNBA and COMBAR. Paul enjoys sailing, skiing and architecture.
