This professional negligence claim concerned the conduct of administrators of an engineering company. The Court of Appeal was required to consider whether the liquidator could save initially defective proceedings by a late amendment to substitute himself for the company as claimant and by invoking the misfeasance procedure under the Insolvency Act 1986.
